NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 21, 2012, executed by Borrower(s), Phillip D Estep, to Amy J. Haynir, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3923, at Page 403. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 314 Skyline Dr, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 28, 2025, of record in the Clerk's Office in Book 4777, Page 96. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 16th day of January, 2026 at 11:30 a.m. All of that certain lot or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, and being the northerly one-half (1/2), of Lot No. Three (3), of Subsection "C", of Section "B", of the Knollwood Addition, as shown upon the map thereof, bearing date the 14th day of May, 1953, entitled, "Map of Section "B" Sub-Sections A-B-C-D, Knollwood Addition, Elk District, Kanawha Co.," which said map is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 18, at pages 46 and 47, the property hereby conveyed fronting 100 feet on the west side of Skyline Drive and being more particularly bounded and described as follows: BEGINNING at an old iron pin in the west line of Skyline Drive, which said iron pin is located at the front common comer of Lots Nos. 2 and 3, of said Subsection "C", of Section "B", of Knollwood Addition, as shown upon the aforesaid map; thence running with the said west line of Skyline Drive, S. 21 05' W., a distance of 100 feet to a stake; thence leaving the said west line of Skyline Drive and running through the said Lot No. 3, N. 66 30' W. 175.50 feet to a stake in the rear line of the said Lot No., 3, at the common comer of the said Lot No. 3, and Lots Nos. 17 and 18, of said Subsection "C", as shown upon the aforesaid map; thence running with the common division line between a part of the said Lot No. 3, and all of Lot No. 18, N. 24 10'E. 100.00 feet to a stake located at the common rear corner between the said Lot No. 3 and Lot No. 2, of said Subsection "C", thence running with the common division line between the last named lots, S. 66 30' E. 173.58 feet to the place of beginning. Being the same property conveyed to Gary Holland and Tasha Holland, by Lori A. Braenovich, by Deed dated August 27, 2010, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2775, at Page 604. This deed is made subject to the restrictions, covenants, reservations, and agreements contained in that certain deed from Laura Ehman Conner and H. G. Conner, her husband, to Leah F. Butcher, dated October 9, 1945, and of record in the aforesaid Clerk's office in Deed Book 724, at page 117. This conveyance is made subject to any and all covenants, restrictions, easements, and reservations which may be a matter of record in the Clerk's office aforesaid and running with the land. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
