NOTICE OF TRUSTEE'S SALE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 25, 2022, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4614, at Page 586, Building Appalachia, LLC did convey unto Raymond Dodson and Joshua Stowers, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on August 11, 2026, at 6:01 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Dunbar District, Kanawha County, West Virginia, and more particularly described as follows: All that certain parcel of land, together with any improvements thereon and appurtenances thereunto belonging, situate on the north side of Interstate No. 64 in the City of Dunbar, Kanawha County, West Virginia, bounded and described as follows: BEGINNING at an old iron pin located on the northern right of way line of Interstate No. 64, being the southernmost corner of that certain parcel of land conveyed to Michael S. Fletcher and Judy E. Fletcher, husband and wife, by deed from George Herman Riffee and Opal M. The said Richard E. Tyree, aka Richard Edward Tyree died testate, a resident of Kanawha County, on or about March 7, 2018, and pursuant to the survivorship clause contained in said deed, his wife became the sole owner thereof. Va" Prepared by Don K. Cunningham, L.L.S., dated June 28, 1983, and which map is or record in the Aforesaid Clerk's Office in Deed Book 2041, at page 621. Being the same property conveyed unto Richard E. Tyree and Rita J. Tyree, husband and wife, by that certain deed dated September 20, 1989, from WESTMORELAND OFFICE CENTER, INC., a West Virginia corporation, of record in the aforesaid Clerk's Office in Deed Book 2235, at page 4. The said Richard E. Tyree, aka Richard Edward Tyree died testate, a resident of Kanawha County, on or about March 7, 2018, and pursuant to his Last Will and Testament of record in Will Book 931, at page 402, he devised his undivided interest to his wife Rita J. Tyree. The party of the first part does further GRANT and CONVEY unto the parties of the second part, their successors and assigns, all of its right, title and interest in and to all rights-of-way and easements in and over "Office Drive" and "Office Lane" as the same are shown upon that certain map entitled "Plat Plan of Lots 1 & 2 of Dunbar Office Park Showing Location of Office Drive & Reservation, Dunbar, W. Va", dated August 26, 1980, of record in their aforesaid Clerk's Office in Deed Book 1988, at page 660, and as the same may be constructed for purpose of ingress and egress from the lands herein conveyed to and from Westmoreland Drive; and does further GRANT and CONVEY unto the parties of the second part, all its right, title and interest in prior reservations, rights of way and easements in, over and appertaining to Lots Number 1 through 6 of Dunbar Office Park. This conveyance is further made subject to that certain declaration of protective covenants entitle, "DECLARATION OF PROTECTIVE COVENANTS PERTAINING TO LOTS IN DUNBAR OFFICE PARK, CITY OF DUNBAR, KANAWHA COUNTY, WEST VIRGINIA," of record in the aforesaid Clerk's Office in Deed Book 1953, at page 387; and that certain "REVISED DECLARATION OF PROTECTIVE COVENANTS PERTAINING TO LOTS IN DUNBAR OFFICE PARK, CITY OF DUNBAR, KANAWHA COUNTY, WEST VIRGINIA," dated August 23, 1983, and of record in the aforesaid Clerk's Office in Deed Book 2041, at page 618. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 600 Westmoreland Drive, Dunbar, WV 25064. AND BEING the same real estate which was conveyed to Building Appalachia, LLC, by Deed dated October 25, 2022, from Rita J.
