TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 29, 2008, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3537, at Page 69, and modified by Corrective Affidavit recorded on April 10, 2025 in Book 57, at Page 471, Ethel F Belcher did convey unto James T. Cooper, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as owner trustee for CIM Trust 2025-NR1 to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on June 1, 2026 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 - Chas SA District, Kanawha County, West Virginia, and more particularly described as follows: Land referred to in this commitment is described as all that certain property situated in in the County of Kanawha, and State of WV and being described in a Deed dated 05/14/1988 and recorded 05/16/1988 in Book 2203 page 313 among the land records of the County and State set forth above, and referenced as follows: All those two (2) certain tracts or parcels of land, situate, lying and being in the City of Charleston, Charleston South Annex, Loudon District, Kanawha County, West Virginia, and being portions of Lot Nos. Twelve (12) and Thirteen (13) in Block ' G" of South Park, as set out and shown on map or plat of said South Park, duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 6, at pages 10 and 11. Parcel No. 6456818 Beginning at a point in the northerly line of a 25 foot road called Aspen Drive, formerly called Alcoa Drive, said point being in said northern line of Aspen Drive, the front common corner between Lot Nos. 6 and 12 of Block G. South Park, said beginning point being also 233.91 feet N. 71 21' W. of the intersection of said Aspen Drive with South Park Road; thence from said beginning point and running along the northerly line of Aspen Road N. 71 21' W. 80 feet to a point therein, said last mentioned point being the front common corner between Lot Nos 13 and 14 of Block G South Park; thence leaving Aspen Drive and running with the division line between said Lot Nos.13 and 14, N. 23 30' E 174 feet to a point, rear common corner of said Lot Nos. 13 and 14, said last mentioned point being also in the southerly line of a driveway described in deed from Allegheny Land Company, a corporation, to M. Ray Gunnoe, dated September 25, 1941, of record in the above mentioned Clerk's Office in Deed Book 601, page 97; thence running with the southerly line of said driveway S.85 03' E.167.3 feet to a point, said last mentioned point being a common between Lots No. 6,8,9 and 12 of Block G of said South Park; thence running with the division line between said Lot Nos. 6 and 12, S. 43 10' W. 234.4 feet to the place of beginning and being, the same land set out on a map or plat dated September 3,1976 made by Charles F. Coleman, L.L.S 384, and entitled "No. 3380 Aspen Drive being part of Lots 12 and 13 Block "G" South Park M.B. 6 P 10-11 Now in the City of Charleston in Loudon District Kanawha County W. VA to be conveyed to Harold Dean Kirk and Anneliese Kirk" which said last described map is attached to the deed to the parties of the first part, and being the same property conveyed to the parties of the first part by Carroll W. Houchins and Karen Doska Hill Houchins, his wife, by deed dated the 9th day of September,1976, of record in the aforesaid Clerk's Office in Deed Book1807, at page 317. For the consideration aforesaid, the parties of the first part do also hereby Grant and Convey unto the parties of the second part, as joint tenants with the right of survivorship and not as tenants in common, a perpetual easement and right of way to use, in common with other lot owners is said Block G of South Park, for ingress and egress, the driveway which immediately abuts, on the north the above described tract of land, which said driveway is shown on the above described map and which said driveway is set out and described in the heretofore referred to deed from Allegheny Land Company, a corporation, to M. Ray Gunnoe, dated and recorded as aforesaid, said driveway being also described in a deed from M. Ray Gunnoe and Iva M. Gunnoe, his wife, to J.C. Montague, dated May1, 1969, of record in the aforesaid Clerk's Office in Deed Book 1554, at page 25. The oil and gas are excepted and reserved. This conveyance is further made subject to all other reservation, restrictions, easements and rights of way as set forth or referred to in all prior deeds in the chain of title. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3380 Alcoa Drive, Charleston, WV 25304. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.
